This is a controversial ruling. Senior Judge John C. Uhler concluded that the registration provision of Pennsylvania’s Sexual Offender Registration and Notification Act prevents the court from considering the many unique attributes of youth offenders and therefore unfairly treats juvenile offenders the same as adult sex offenders. The York County ruling is on appeal to the Pennsylvania Superior Court, whose decision would apply state wide.
