Are Premarital Agreement Legal?
Yes, provided certain requirements are met. Generally, a
premarital agreement must be in writing, must be signed by both parties,
must not be induced by fraud or threat and must provide complete financial disclosure between the parties. The parties must each have their own attorney prior to signing the agreement.
A premarital agreement may not address certain issues, such as diminishing the right to child support or a waiver of basic individual rights. |
